1. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation.
• Impersonate or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the operation of the Site or the servers or networks connected to the Site.
• Attempt to gain unauthorized access to any part of the Site or any other systems or networks.
• Use the Site to transmit or distribute any viruses, worms, or other malicious code.
• Use the Site to collect or harvest any information about other users.

2. User accounts

If you create an account on the Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

3. Content

All content on the Site, including text, graphics, logos, images, questions, rationales, and software, is the property of Nexclex or its licensors and is protected by copyright and other intellectual property laws. You may not copy, share, scrape, or redistribute Site content without our prior written consent.

4. Purchases and subscriptions

If you purchase any products or services through the Site, you agree to pay the applicable fees and taxes. We may change our prices at any time. Practice includes a 3-day trial, then bills monthly. Exam is billed every 60 days and Pro every 90 days, starting at checkout. Exam and Pro auto-renew at the end of each period until you cancel in Settings. Canceling stops future charges. You keep access through the end of the paid period.

Monthly Practice subscriptions are not eligible for a refund. You can cancel at any time to avoid future payments. All sales are otherwise final unless we state otherwise.

5. Disclaimer of warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NEXCLEX DOES NOT PROMISE OR GUARANTEE THAT YOU WILL PASS THE NCLEX. The limited subscription extension described in the NCLEX Pass Guarantee below is the sole remedy available under that offer.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY CONTENT, PRODUCTS, OR SERVICES OFFERED THROUGH THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Site or your breach of these Terms.

8. Governing law

These Terms shall be governed by and construed in accordance with the laws of Virginia, without regard to its conflict of law principles.

9. Changes to these Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised "Effective Date." We encourage you to review these Terms periodically for any updates.

10. NCLEX Pass Guarantee

The Nexclex Pass Guarantee is a limited subscription extension, not a promise that you will pass the NCLEX. If you purchase a paid Practice, Exam, or Pro plan, do not pass the NCLEX, and provide Nexclex with your official Candidate Performance Report (CPR) showing the unsuccessful result, we will extend your eligible plan at no cost for the same duration associated with the qualifying purchase.

To request the extension, email [email protected] within 30 days of the date on your CPR. Include the account email, proof of the qualifying purchase, and the complete official CPR. The subscription must belong to the person named on the CPR, and Nexclex may verify the information before applying the extension.

A qualifying monthly Practice purchase receives one additional month, Exam receives 60 additional days, and Pro receives 90 additional days. The guarantee is limited to one extension per qualifying purchase, has no cash or refund value, cannot be transferred or stacked, and does not apply to trial-only access or accounts that violate these Terms.
